These Terms and Conditions set out the basis on which Waste Disposal Wandsworth provides waste collection and related services to customers within our service area. By making a booking, confirming an order, or allowing our team to collect waste from your premises, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, the following expressions shall have the meanings set out below:
Customer means any individual, business, organisation, landlord, managing agent, or other party that requests or receives services from Waste Disposal Wandsworth.
Services means any waste collection, rubbish removal, bulky item collection, recycling, clearance, loading, transport, or disposal service provided by Waste Disposal Wandsworth.
Premises means the address or location at which the Services are to be carried out or from which waste is to be collected.
Waste means any materials, items, or goods presented for collection, removal, or disposal under the Services, including general household waste, commercial waste, bulky items, garden waste, and recyclable materials, unless otherwise specified.
Waste Disposal Wandsworth provides scheduled and one-off waste collection and removal services within our designated service area. Services typically include loading of waste, transportation, and disposal or recycling at appropriate facilities, in accordance with applicable UK waste regulations.
The exact scope of a particular service, including the type and volume of waste to be collected, any access requirements, and the charges payable, will be confirmed in writing or verbally at the time of booking or confirmation.
We reserve the right to refuse to collect or handle any waste that we reasonably believe to be hazardous, illegal, improperly packaged, unsafe to handle, or beyond the agreed scope or volume.
3.1 Making a booking
Bookings may be made by telephone, email, or via any booking tool or method we make available. When making a booking, you must provide accurate and complete information, including:
• Your full name or business name
• Contact details
• Collection address and any access details
• Description and estimated volume or weight of the waste
• Preferred date and time window for collection.
3.2 Booking confirmation
Your booking is not considered confirmed until we have acknowledged it and, where required, you have accepted our quoted price. We may confirm bookings verbally or in writing. We may, at our discretion, require a deposit or full payment in advance to secure the booking.
3.3 Changes to bookings
Any changes to the booking, including changes to date, time, location, or the nature and volume of the waste, must be requested as early as possible. We will use reasonable efforts to accommodate such changes, but cannot guarantee availability or that the original price will remain unchanged. We reserve the right to revise our quotation if there are material changes to the information originally provided.
The Customer is responsible for ensuring that we have safe, reasonable, and lawful access to the Premises at the agreed time. This includes arranging any necessary permissions, parking, loading space, and entry codes or keys as applicable.
Waste must be presented in a manner suitable for collection, with any sharp, fragile, or heavy items identified and, where appropriate, securely packaged. We may refuse to handle items that present a risk to the health and safety of our staff or the public.
If we are unable to access the Premises, or if waste is not available as agreed, the failed visit may be treated as a chargeable attendance. In such circumstances, we may charge a call-out fee or retain any deposit paid to cover our time and costs.
5.1 Acceptable waste
We typically collect household waste, commercial waste, light construction waste, garden waste, recyclable materials, and bulky items, provided they are lawful to collect and dispose of under UK regulations and within our licensing arrangements.
5.2 Prohibited or restricted items
We do not normally collect hazardous waste such as clinical waste, asbestos, chemicals, solvents, fuel, gas cylinders, explosives, pressurised containers, or any materials requiring specialist handling or permits. Electrical items, fridges, freezers, or other regulated items may be subject to additional charges or specific arrangements.
We reserve the right to refuse any waste which we reasonably consider unsafe, non-compliant with applicable laws, or beyond the agreed scope of the service. If we discover such items after collection has commenced, we may adjust the price or require separate arrangements for their lawful disposal.
6.1 Quotations
Prices may be quoted based on estimated volume, weight, item type, access conditions, or a combination of these factors. All quotations are given in good faith based on the information supplied by the Customer at the time of booking.
A quotation is not a fixed price if the actual waste volume, type, condition, or access circumstances differ materially from those described. We may revise our price on arrival if the job is significantly larger, more complex, or more time-consuming than initially indicated.
6.2 Additional charges
Additional charges may apply for:
• Extra labour or time if loading is significantly delayed
• Difficult access or the need to carry items over long distances or up multiple flights of stairs
• Parking costs, congestion charges, or other third-party fees
• Special handling or disposal of particular items where required by regulation.
We will advise you of any additional charges as soon as reasonably practicable and seek your agreement before proceeding.
7.1 Methods of payment
We accept payment by cash, bank transfer, card payment, or other methods notified to you at the time of booking. For certain services or for new customers, we may require full or partial payment in advance.
7.2 Timing of payment
Unless otherwise agreed, payment is due on completion of the service on the day of collection. For business customers, we may agree credit terms, in which case invoices are payable by the due date stated on the invoice.
7.3 Late payment
If payment is not received by the due date, we reserve the right to charge interest on the outstanding amount at the statutory rate applicable in the UK, as well as reasonable costs of recovery, including administrative and legal costs.
8.1 Customer cancellations
You may cancel or reschedule your booking by contacting us directly. Where you provide at least 24 hours notice before the agreed collection time, any deposit paid may be refunded or transferred to a new booking at our discretion.
If you cancel with less than 24 hours notice, fail to grant access, or fail to present the waste for collection, we may retain any deposit paid or charge a cancellation or call-out fee to cover our costs and lost time.
8.2 Our right to cancel or reschedule
We may cancel or reschedule a booking if we are unable to attend due to circumstances beyond our reasonable control, including but not limited to vehicle breakdown, severe weather, staff illness, or legal or regulatory restrictions. In such cases, we will notify you as soon as practicable and offer an alternative date or a refund of any payment made for the affected service.
We may also cancel the service if we discover that the waste is materially different from that described, is hazardous, or cannot be lawfully or safely handled. In such circumstances, we will not be obliged to complete the job, but we will not charge you for services not carried out, other than any lawful costs incurred up to that point.
We will use reasonable skill and care in providing our waste collection and removal services. However, timing is not guaranteed, and any arrival times given are estimates only. We do not accept liability for minor delays, provided we use reasonable efforts to attend on the agreed day or at the next available opportunity.
Our staff will act professionally and courteously while on your Premises and will endeavour to minimise any disruption. You agree to treat our staff respectfully and not to engage in any abusive or threatening behaviour.
10.1 Damage to property
We will take reasonable care while loading and removing waste from your Premises. However, you acknowledge that some risk of minor scuffs or marks may be inherent where large or heavy items are removed from confined spaces. We shall not be liable for minor cosmetic damage that is incidental to the proper performance of the Services.
Any damage you wish to claim must be reported to us in writing as soon as reasonably possible, and in any event within 7 days of the service date, providing reasonable details and evidence.
10.2 Exclusions of liability
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.
Subject to the above, we will not be liable for any loss of profit, loss of revenue, loss of anticipated savings, loss of business, or any indirect or consequential loss arising out of or in connection with the Services.
Our total liability to you in respect of all claims arising out of or in connection with the Services shall not exceed the total charges paid or payable for the specific service giving rise to the claim.
You warrant that you are the owner of the waste or have full authority from the owner to request its removal and disposal, and that the waste does not contain any items that are unlawful to possess, transfer, or dispose of.
You agree to indemnify us against any claims, losses, damages, fines, or expenses we incur as a result of any breach by you of these warranties, including but not limited to any unlawful or hazardous materials included in the waste without our knowledge.
We will handle, transport, and dispose of waste in accordance with applicable UK laws and regulations on waste, duty of care, and environmental protection. Where required, we will use licensed facilities and keep appropriate records of waste transfer and disposal.
The Customer agrees not to require or encourage us to act in any way that would breach applicable environmental or waste regulations. We reserve the right to terminate the service immediately if we reasonably believe that continuing would result in a breach of such laws.
We may collect and process personal data such as your name, contact details, and service history for the purposes of handling bookings, providing Services, managing accounts, and complying with our legal obligations. Personal data will be handled in line with applicable UK data protection laws.
We will not sell your personal data to third parties. We may share certain information with our contractors, service partners, or regulatory authorities where necessary for the provision of the Services, for compliance with the law, or for the protection of our legal rights.
If you are dissatisfied with any aspect of our Services, you should contact us promptly with details of your complaint. We will investigate in good faith and seek to resolve the matter through discussion or reasonable remedial action where appropriate.
If a dispute cannot be resolved amicably, either party may seek to enforce its rights through the courts of England and Wales as set out in these Terms and Conditions.
We may amend or update these Terms and Conditions from time to time to reflect changes in our services, business practices, or applicable law. The version in force at the time of your booking will apply to your service, unless a later version is expressly agreed in writing by both parties.
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed severed to the extent necessary, and the remaining provisions shall continue in full force and effect.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.
